Irish Water has agreed with the Law Society of Ireland Conveyancing Committee to give the confirmations outlined below to reduce the administrative burden on solicitors acting in conveyancing transactions.
Irish Water confirms that solicitors acting for purchasers of second hand dwellings may rely on a letter issued by the local authority on any date confirming that the roads abutting the property are in charge, as evidence that the applicable water and waste water infrastructure abutting the property is now vested in Irish Water. This confirmation is applicable even where a letter from the local authority states that it cannot confirm the position regarding water services. If the property which you are selling does not fall into the above category and you require confirmation directly from Irish Water to confirm whether the water and waste water infrastructure abutting a property is the responsibility of Irish Water, please apply in writing to email@example.com. All applications should include a solicitors letter accompanied with a land registry map.
