Find out about water responsibilities when selling a home.

Uisce Éireann has agreed with the Law Society of Ireland Conveyancing Committee to give the confirmations outlined below to reduce the administrative burden on solicitors acting in conveyancing transactions.

Uisce Éireann confirms that solicitors acting for purchasers of second hand dwellings may rely on a letter issued by the local authority on any date confirming that the roads abutting the property are in charge, as evidence that the applicable water and waste water infrastructure abutting the property is now vested in Uisce Éireann. This confirmation is applicable even where a letter from the local authority states that it cannot confirm the position regarding water services. If the property which you are selling does not fall into the above category and you require confirmation directly from Uisce Éireann to confirm whether the water and wastewater infrastructure abutting a property is the responsibility of Uisce Éireann, please apply in writing to ticqueries@water.ie.

All applications should include a solicitor’s letter accompanied with:

  • an Eircode or clear map identifying the property
  • a letter from the local authority stating whether the roads are in charge
  • the reason why the practice direction doesn’t apply
